Professor Alexandra Lahav will speak at a symposium at the New York University School of Law, to be held Dec. 2-3, 2016, on the 50th anniversary of the Class Action Rule, which was promulgated in 1966. Her topic will be Mass Tort Class Actions: Past and Future.
Professor Sachin S. Pandya will present his working paper, Employer Rights Against Worker Involuntary Servitude, at the Colloquium on Scholarship in Employment and Labor Law, September 23-24, 2016, in Seattle, Washington.
The United States Court of Appeals for the Eleventh Circuit cited a paper co-written by Professor John Aloysius Cogan Jr. in an opinion released July 11, 2016, in In Re: Bayou Shores SNF. In 2014, the U.S. Department of Health and Human Services terminated a Medicare provider agreement with Bayou Shores, a skilled nursing facility in Florida, which led to loss of the facility's Medicaid agreement, as well. The company filed for bankruptcy and a U.S. Bankruptcy Court judge ordered the provider agreements reinstated. On appeal, the U.S. District Court found that the Department of Health and Human Services, not the Bankruptcy Court, has jurisdiction in such cases. The Court of Appeals for the Eleventh Circuit agreed, in an opinion written by Judge Raymond C. Clevenger, which cited the paper Administrative Channeling Under the Medicare Act Clarified: Illinois Council, Section 405(h), and the Application of Congressional Intent by Cogan and Rodney A. Johnson, published in 2000 in the Annals of Health Law.
Professor Alexandra Lahav will present her paper The Disintegration of Procedure at faculty workshops at the University of Virginia School of Law on Sept. 2, 2016, at the University of Nevada Las Vegas Law School on Oct. 18, 2016, and Harvard Law School on Nov. 10, 2016.
Professor Alexandra Lahav will speak at the American Bar Association's 20th Annual National Institute on Class Actions Oct. 19, 2016. in Las Vegas. She and Professor John C. Coffee Jr. of Columbia Law School will address the topic The Past Year in Class-Action Action.
